Terms of Service for Atlantis Painting LLC

These Terms of Service govern the use of the website of Atlantis Painting LLC and the studio services that the company provides from its paint drop studio in Roy, Utah. The company is Atlantis Painting LLC, and its address is Atlantis Painting LLC, 2821 W 4225 S, Roy - 84067-9649, United States (US). By using the website, requesting an estimate sheet, booking a studio visit or accepting a project proposal, you agree to these terms. Please read them before you commit to a service.

We have written these terms in direct language so that a reader can understand the obligations on both sides. Where a term uses the words we, us or our, it refers to Atlantis Painting LLC. Where it uses the words you or your, it refers to the person using the website or engaging the studio. If you do not agree with these terms, please do not use the website or engage the studio.

These terms work together with the estimate sheet, the crew notes and the signed walkthrough checklist that apply to a specific project. Where a project document addresses a topic in more detail than these terms, the project document applies to that project to the extent of the conflict. Nothing in these terms removes a right that the law gives you and that cannot be waived.

1. Acceptance of These Terms

By accessing the website, submitting a contact form, requesting an estimate sheet or scheduling a studio service, you confirm that you have read these terms and that you agree to be bound by them. If you are accepting on behalf of an organization, you confirm that you have authority to bind the organization to these terms and that you accept them on its behalf.

You must be at least eighteen years old to engage the studio for a project. A person under that age may visit the website with a parent or guardian, but the contractual relationship for a project must be formed with an adult who can lawfully enter the agreement. The studio reserves the right to ask for confirmation that a person accepting a proposal has the authority to do so.

These terms do not affect any statutory right that cannot be excluded by agreement. If a provision of these terms is found to be unenforceable, that provision will be limited to the smallest extent necessary and the remaining terms will continue in full force. A failure by the studio to enforce a term on one occasion does not waive the right to enforce it later.

2. The Services We Provide

Atlantis Painting LLC operates a paint drop studio that provides interior painting and related surface preparation services. The studio is organized around six desks: estimate sheet bays, color card runs, crew note desks, prep windows, finish review rounds and walkthrough sittings. Together these desks describe the full route that a project follows from the first measurement to the signed checklist that closes the project.

The exact service delivered for a particular property is described in the estimate sheet for that property. The website describes the studio process in general terms and is not a substitute for the specific estimate sheet. A description on the website does not commit the studio to a particular product, coat count or schedule unless the estimate sheet says so.

The studio may decline to take on a project that falls outside its scope, that involves a hazardous condition it is not equipped to handle, or that cannot be completed to its standard within the available schedule. When the studio declines a project, it will explain the reason in writing where it is practical to do so and, where appropriate, suggest a specialist who may be able to help.

3. Estimate Sheets and Proposals

An estimate sheet is prepared after a studio visit or a detailed remote review of the property. It lists rooms, surfaces, coat counts, the products proposed and a statement of what is included and what is excluded. The estimate sheet is the basis of the arrangement between you and the studio. A verbal figure given in conversation is only an informal indication until the written estimate sheet is issued.

An estimate sheet remains valid for the period stated on the sheet. If the period lapses before a project is accepted, the studio may issue a revised estimate to reflect current material costs and scheduling. A quote is not a commitment to begin work on a particular date until the studio confirms the date and receives any deposit that the estimate requires.

Estimates assume that the surfaces are in the condition observed during the studio visit. Hidden conditions, such as damaged drywall beneath a skim coat or moisture behind a wall, may require additional preparation that was not visible at the time of the visit. If such a condition is found, the studio will describe it, propose the additional work and issue a revised estimate before proceeding.

4. Your Responsibilities as a Client

You agree to provide accurate information about the property, the surfaces to be painted and any condition that may affect the work. You agree to disclose any known moisture problem, structural concern, previous repair or material that may require special handling. Concealing a known condition that later causes damage may limit the studio responsibility for that damage.

You agree to provide clear access to the areas where work will occur, to remove or protect small valuables and personal items, and to let the studio know about any alarm, lock or access procedure that the crew must follow. If a person, pet or fragile object could interfere with the work or be harmed by it, you agree to arrange for that person, pet or object to be kept clear during the prep window and the paint work.

You agree to communicate any change to the scope, color or schedule as early as possible. A change that arrives after materials are ordered or after a prep window has begun may increase cost or extend the schedule, and the studio will explain the effect before acting. You also agree to review the estimate sheet and the crew notes promptly so that questions can be resolved before the work begins.

5. Scheduling and Access

Studio visits, color card runs, prep windows and walkthrough sittings are scheduled by agreement. A date is reserved once the studio confirms it in writing. The studio will make reasonable efforts to arrive at the confirmed time, and will contact you promptly if a delay or an emergency changes that time.

The crew needs a working space that meets basic safety requirements, including adequate light, a source of water where cleaning is required and clear access to the rooms being painted. If a site is not ready at the confirmed time, the studio may reschedule the visit and may charge for the lost time as described in the cancellation section. The studio will not begin work in a space that it considers unsafe.

For commercial properties, the studio will work with your operating hours. Prep windows and finish review rounds can be arranged outside business hours where the estimate sheet allows. Any restriction on working hours, noise or elevator use should be raised before the date is reserved, so that the plan can account for it.

6. Preparation, Protection and Site Conditions

A proper job depends on proper preparation. The studio covers floors with drop cloths, tapes trim and masks openings so that the finish work is protected. The studio patches nail pops, hairline cracks and small holes that are listed on the estimate sheet, sanding and priming where the surface calls for it. Preparation that goes beyond the listed scope is treated as a revision and is estimated before it is performed.

Paint and primer need appropriate temperature and humidity to cure. The studio may delay a coat if the site conditions are outside the range recommended by the manufacturer, because applying a coat in the wrong conditions risks a finish that fails early. A delay for site conditions is not a breach of these terms, and the studio will work with you to find a new date as soon as the conditions allow.

The studio takes care to protect furniture, fixtures and flooring, but some dust and a small amount of overspray risk are inherent in painting work. You agree to remove or protect items that are irreplaceable or highly sensitive before the prep window begins, and the studio will advise on this during the walk through of the property.

7. Color Selection and Approvals

Color is chosen during a color card run, where samples are tested on the actual wall under the light of the room. The studio recommends this step because paint reads differently on a wall than it does on a card or a screen. If you choose to approve a color without a run, you accept the risk that the finished color may differ from the sample you saw elsewhere.

Once you approve a color and a sheen in writing, that approval is the instruction for the paint work. A change after the paint is applied is a revision, and the cost of repainting the affected surface is added to the estimate. The studio will confirm any such change in writing before the additional work begins, so that the cost is known in advance.

The studio uses the product line identified on the estimate sheet unless a substitution is agreed in writing. If a product is unavailable, the studio will propose an equivalent product with a similar finish and will not substitute a lower grade without your written approval. The crew notes record the products actually used so that touch up work can match the original finish.

8. Scope Changes and Revised Estimates

A scope change is any addition, removal or alteration to the work described on the estimate sheet. Examples include adding a room, changing a sheen, adding a wall repair or extending a prep window. The studio will describe the effect of the change on cost and schedule and will issue a revised estimate for your approval before the additional work is performed.

If a change is discovered mid project that could not reasonably have been known during the studio visit, such as damage beneath a painted surface, the studio will pause the affected area and discuss the options with you. You may approve the additional work, defer it or cancel that part of the project. Work on the unaffected areas may continue while the options are discussed.

A revised estimate replaces the earlier estimate for the affected items only. Items that were not changed remain as originally described. The revised estimate is dated and kept with the project file, so that the record of what was agreed is always clear.

9. Fees, Deposits and Payment

The fees for a project are set out on the estimate sheet. A deposit may be required to reserve materials and a schedule, and the amount and due date are stated on the estimate. The remaining balance is due according to the schedule on the estimate, which commonly requires payment after the finish review rounds and before or at the walkthrough sitting.

Payments are processed through a payment provider selected by the studio. The provider handles card data under its own security program, and the studio keeps a record of the invoice and the payment status. A late payment may be subject to a charge where the estimate or the applicable law allows it, and the studio will explain any such charge in writing.

If you believe an invoice does not match the agreed scope, contact the studio within the period stated on the invoice so that the estimate sheet, the crew notes and the payment record can be reviewed together. The studio will correct a genuine error promptly. A dispute about an invoice does not remove the obligation to pay the undisputed portion of the balance.

10. Cancellation and Rescheduling

You may cancel or reschedule a scheduled visit, a color card run or a prep window by notifying the studio in writing. The studio asks for as much notice as is practical. If a visit is cancelled at short notice or if the site is not ready when the crew arrives, the studio may charge for the time and the materials already committed to the visit.

The studio may cancel or reschedule a visit for safety, weather, site conditions or an emergency. Where the studio cancels, it will offer a new date as soon as is practical and will not charge for the cancelled visit. If the studio cancels a project after the deposit has been paid, any unused portion of the deposit will be refunded or applied to a rescheduled date at your choice.

If a project is cancelled after work has begun, the studio will stop at a natural break, protect the space and set out the cost of the work completed and the materials used. You remain responsible for the reasonable cost of work already performed and materials already purchased for the project.

11. Workmanship Standards and Review Rounds

The studio performs its work with the care and skill expected of a professional paint studio. The standard of finish is described on the estimate sheet, which may distinguish, for example, a standard repaint from a higher grade finish that involves additional preparation and coat work. The finish review rounds are the studio method for checking that the work meets the stated standard.

The first review round checks coverage, lap marks, thin spots and sheen drift under flat light. The second round checks the finish under a raking light angled down each wall. Any correction found is made before the walkthrough sitting, and the affected area is reviewed again. The completed review checklist is part of the project record, and a copy is provided to you at the walkthrough.

The walkthrough sitting is the point at which the project is accepted. If you believe a room does not meet the agreed standard, raise the point during the walkthrough so that it can be recorded and resolved. The studio will not treat the project as closed until the agreed corrections have been made and the checklist is signed, unless you accept the space as it stands.

12. Limited Finish Warranty

Subject to the conditions in this section, the studio offers a limited warranty on the finish it applies. The warranty covers peeling, blistering or premature failure that results from defective workmanship on surfaces that were prepared by the studio and that remain in the condition described at the walkthrough. The duration of the warranty and any exclusions are stated on the estimate sheet for the specific project.

The warranty does not cover damage caused by a third party, by structural movement, by water intrusion, by a surface condition that was not disclosed, by an incompatible product applied later by someone else, or by normal wear in a high traffic area. The warranty also does not cover a color change or a change of preference; those are treated as a new project.

To make a warranty claim, contact the studio at estimates@atlantispaint.surf with a description of the issue and, if possible, a photograph. The studio will review the crew notes and the review checklist for the project, inspect the affected area and decide whether the warranty applies. If it does, the studio will arrange the correction at no charge for the labor covered by the warranty.

13. Property, Materials and Access

You confirm that you have the right to authorize the work on the property. If the property is rented, you are responsible for obtaining any consent required from the owner or the landlord. If the property is subject to a home owners association, you are responsible for meeting any rule about exterior color, access or working hours.

Materials purchased for a project remain the property of the studio until they are paid for and installed. Any surplus paint becomes your property at the walkthrough sitting, and the studio will label the containers with the room, the product and the sheen. Leftover material that you do not want will be disposed of according to local regulations.

The crew will leave the space clean and organized at the end of each work day. You agree to provide access to a power source and to any running water needed for cleaning where the estimate assumes such access. If access is interrupted, the studio will work around the interruption and will notify you if the interruption affects the schedule.

14. Third Party Materials and Suppliers

The studio uses products from established manufacturers and suppliers. Where a product carries a manufacturer warranty, that warranty is separate from the studio warranty and is subject to the manufacturer conditions. The studio will pass on the product information that it holds so that you can register a product or make a claim with the manufacturer where the product includes such a program.

If a supplier delays a delivery or discontinues a product, the studio will notify you and propose an equivalent alternative. A substitution requires your written approval where the alternative differs materially in finish or grade. The studio will not use a material that it believes is unsuitable for the surface, even if the material is cheaper.

Where the studio coordinates with a third party, such as a drywall specialist, an electrician or a flooring contractor, that third party remains responsible for its own work. The studio will communicate clearly about the sequence of work and will not ask a third party to perform a task outside that party professional scope.

15. Intellectual Property and Website Content

The website, its text, its layout and its visual elements are the property of Atlantis Painting LLC and are protected by copyright and other laws. You may view the website and print a copy of these terms or the privacy policy for your own reference. You may not reproduce, republish, distribute or create a derivative work from the website content for a commercial purpose without written permission from the studio.

The studio name, the studio marks and the names of the studio desks are the property of the studio. You may refer to the studio by name in a factual review or a recommendation, but you may not use a studio mark in a way that suggests a partnership, endorsement or sponsorship that does not exist.

If you send the studio a testimonial, a photograph or another submission, you grant the studio a non exclusive right to use the submission to describe the studio service, provided that the studio will ask for your approval before using your name or a photograph of your property. You can withdraw that approval at any time by writing to the studio.

16. Prohibited Uses of the Website

You agree not to use the website in a way that is unlawful, harmful or disruptive. You agree not to attempt to gain unauthorized access to the website systems, not to introduce malicious code and not to interfere with the availability of the website for other visitors. You agree not to use an automated tool to scrape the website content for a commercial purpose without written permission.

You agree not to submit a false identity, a misleading claim about a property or a message intended to harass or defraud the studio. The studio may refuse a message, restrict access to the website or decline a project where it has a reasonable belief that a person has acted in breach of this section.

Where a message or a submission is removed because it breaches this section, the studio will keep a record of the reason for the removal. Nothing in this section limits the studio right to report a serious breach to the relevant authority or to seek a legal remedy for harm caused by the breach.

17. Limitation of Liability

To the extent permitted by law, the studio is not liable for indirect, incidental, special or consequential loss arising from the use of the website or from a project, including loss of profit, loss of business opportunity or loss of data. The studio responsibility for direct loss arising from a project is limited to the amount paid for the affected service, except where the law requires a different result.

Nothing in these terms limits liability for fraud, for willful misconduct, for death or personal injury caused by negligence, or for any other liability that cannot be limited by law. If a jurisdiction does not allow some part of this limitation, that part will be read down to the minimum extent required and the rest of the section will remain in effect.

The website is provided as it stands. The studio works to keep the information on the website accurate, but it does not promise that every detail will always be current, and it does not accept responsibility for a decision based on a general description where a specific estimate sheet would have been the proper basis.

18. Indemnification

You agree to indemnify the studio against a claim, loss or expense that arises from your breach of these terms, from information that you provided that was inaccurate or incomplete, or from your use of the property in a way that affects the work. This includes reasonable legal costs where the studio has to defend a claim that results from such a breach.

This obligation does not apply where the claim results from the studio own negligence or breach of these terms. The studio will notify you promptly if it receives a claim that may fall under this section, and it will work with you in good faith to resolve the matter. The studio will not settle a claim in a way that admits fault on your part without your agreement.

The indemnity in this section survives the completion of a project and the termination of the relationship between you and the studio. It is intended to cover the financial consequence of a breach and is not intended to penalize a client who has acted honestly.

19. Disputes and Governing Law

The studio would rather resolve a concern directly than through a formal process. If a disagreement arises, please write to estimates@atlantispaint.surf with a clear description of the issue and the outcome you are seeking. The studio will review the estimate sheet, the crew notes and the review checklist, and a lead who was not responsible for the original decision will reply in writing within a reasonable period.

If a concern cannot be resolved by discussion, the dispute will be governed by the laws of the State of Utah, without regard to its conflict of law rules, and the courts located in the State of Utah will have jurisdiction, unless a mandatory consumer law in your place of residence gives you a different right. Both parties agree to attempt a good faith resolution before taking a formal step.

Nothing in this section prevents either party from seeking urgent relief where a delay could cause harm, such as an order to protect property or to prevent further damage. Each party will bear its own legal costs unless a court or a statute provides otherwise.

20. Changes to These Terms

The studio may revise these terms from time to time to reflect a change in the service, in the law or in the way the website operates. When a revision is made, the date at the top of the page is updated and the new version is posted on the website. A material change will be described in a short notice on the homepage or in a message to active clients.

A project is governed by the version of these terms that was in effect when the estimate sheet for that project was accepted, unless the revised terms are more protective of the client or the client agrees to the revision. A revision to the website terms does not change a previously accepted estimate sheet on its own.

If you do not agree with a revision, you may stop using the website. If a revision would materially affect an active project, the studio will discuss the effect with you before the revision applies to that project, so that you can decide whether to continue.

21. Contact Information

Questions about these terms can be sent to Atlantis Painting LLC at estimates@atlantispaint.surf, by phone at +17197923797, or by post at Atlantis Painting LLC, 2821 W 4225 S, Roy - 84067-9649, United States (US). The studio answers questions during normal business hours and aims to reply to a written question within one business day.

If you are writing about a specific project, include the property address as it appears on the estimate sheet and the approximate date of the studio visit so that the relevant record can be found. A clear description of the question helps the studio answer it properly the first time.

These terms, together with the estimate sheet, the crew notes and the signed walkthrough checklist for a project, form the whole agreement between you and the studio for that project. They replace any earlier discussion or understanding on the same subject, except where a later written document signed by both parties says otherwise.
